New Delhi: The Supreme Court rejected a petition challenging the delimitation exercise in the Jammu and Kashmir Union Territory, which attempts to redraw boundaries of the legislative assembly and Lok Sabha constituencies in the area.
The decision of Indian Supreme Court dismissing the petition challenging validity of delimitation exercise in Jammu and Kashmir is yet another black spot on the tainted Indian judicial system. However, Indian Supreme Court rejection of Delimitation petition clearly indicates RSS influence over judiciary.
As per the constitutional experts the decision of delimitation exercise to be held prior to 2031 is non – constitutional move based on ulterior motives RSS influenced Hindutva regime.
People in the Kashmir Valley believe that proposal of the delimitation exercise is part of the BJP’s “dream project” of installing a Hindu Chief Minister (CM) in the Muslim-majority J&K.
The ISC’s decision has evoked widespread criticism in Indian Administered Kashmir, the political leaders of Indian Administered Kashmir have alleged that the decision reeks of a partisan approach. Former CM and NC vice-president Omar Abdullah said, “The recommendation of the J&K delimitation commission are unacceptable.
The distribution of newly created assembly constituencies with 6 going to Jammu & only 1 to Kashmir is not justified even by the data of the 2011 census”. People’s Democratic Party President Mehbooba Mufti said, “The real game plan is to install a BJP lead Hindu government in Indian Administered Kashmir which will legitimize the illegal & unconstitutional decisions of August 2019”.
People Conference Chairman Sajad Gani Lone said, the report “reeks of a bias” and is a “shock to those who believe in democracy in Kashmir”. “The proposals of the delimitation commission are totally unacceptable.
What a shock for those who believe in democracy”. CPI (M) leader Mohammad Yousuf Tarigami said, it is another step to further dis-empower Kashmiris politically; he termed the complete exercise of Delimitation Commission as “Divisive and unacceptable”.
Senior Congress leader in Indian Administered Kashmir GN Monga also termed the exercise that has suggested six new Assembly seats for Jammu and only one for Kashmir as unacceptable which has been done to skew the balance of power.
Moreover, Gupkar alliance (an alliance of al main stream political parties) has also unanimously rejected the report of the delimitation commission. Delimitation is product of J&Ks illegal Reorganization; no delimitation exercise was possible in J&K till 2031.
This was before August 2019, when the BJP-led Union government, along with effecting other constitutional and legal changes, repealed the law governing delimitation in the erstwhile state. India is going to have delimitation in 2026 and though India has no legal jurisdiction to include Jammu and Kashmir being disputed region in the light of UN resolution, India illegally undertook the exercise in the garb of abrogation of Articles 370 & 35-A.
The Indian illegal action of striping the J&K from stately status is being termed as the basis of series of illegal action including posing of laws like highly objectionable domicile law which enable residents of India to obtain domicile of Kashmir thus enabling settlement (mainly Hindus) to alter the demography of the States.
The intention of BJP/ RSS government is clear to manipulate political factors in its favour in total disregard of the aspirations of people of Indian Administered Kashmir and UN resolutions. The decision on delimitation is yet another black spot on the tainted Indian judicial system under RSS.
India has deliberately done the delimitation, so that it can hold and win election to convince the world of its commitment to the democratic values.
Indian justice system has completely failed to stand with the oppressed rather it has become complacent to the culprits. India at president can be truly related to the neo-Nazi Germany under Hitler’s rule and the persecution of minorities to the same scale and level as the Jews of Germany faced at that time. India is heading towards a genocidal state, thus brewing a human catastrophe.
Former Kashmiri bureaucrat Lateef-ul-Zaman Deva said, the delimitation has been carried out in violation The J&K Reorganization Act 2019 and The Delimitation Act-2002.
“The proposal is highly objectionable as it has been carried out to disproportionately empower one community by disempowering the other”. The situation of Indian Administered Kashmir is rapidly moving towards an indigenous civil war, any such development will certainly affect Pakistan and destroy regional peace.
Pakistan has repeatedly demanded a peaceful solution of Kashmir problem as per the aspirations of people of Indian Administered Kashmir and UN resolution.
